General Terms and Conditions (GTC)
1. Scope of Application
1.1. These General Terms and Conditions apply to all contracts for the delivery of goods from our online shop that you, as a consumer or entrepreneur, conclude with kreativ wedding GbR, Bahnstrasse 25, 40822 Mettmann, Phone: 015154784313, Email: shop@kreativ-wedding.de.
1.2. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly not attributable to their commercial or self employed professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity which, when concluding a legal transaction, acts in the exercise of its commercial or self employed professional activity.
1.3. Our General Terms and Conditions apply exclusively. Deviating, conflicting or supplementary terms shall only become part of the contract if and to the extent that we have expressly agreed to their applicability. This requirement of consent applies in every case, for example also if we carry out the contract without reservation in the knowledge of such terms.
2. Conclusion of Contract
2.1. The presentation of the goods in our online shop constitutes a legally binding offer on our part to conclude a contract. You can accept this offer by selecting the desired goods, placing them in the shopping cart, going through the order process and clicking the button that completes the order process. Alternatively, you may also accept this offer by email.
2.2. We store the contract text after the contract has been concluded. We will send you the data of your order and our General Terms and Conditions by email. If you create a customer account, you can view the data of your order in the customer account after the contract has been concluded. You can view our General Terms and Conditions in their current version at any time in our online shop.
2.3. The languages available for the conclusion of the contract are German and English.
2.4. You can review your entries at any time before placing an order and detect input errors. If necessary, use the functions available in your browser to enlarge the display of your entries. You can correct your entries by using the correction options provided in the order process and by making new entries using your mouse and keyboard. You can cancel the order process at any time before placing an order by closing the browser.
3. Right of Withdrawal

4. Prices
4.1. The prices stated in our online shop are plus statutory value added tax, unless otherwise stated in the description of the goods.
4.2. If shipping or transport costs are incurred, these are indicated separately in the description of the goods.
4.3. In the case of deliveries to countries outside the European Union, additional costs may be incurred (customs duties, import VAT, fees for currency exchange and payment transactions etc.) which are to be borne by you and do not fall within our area of responsibility. Payment is due as soon as you have granted a SEPA direct debit mandate and the period for the SEPA direct debit pre-notification has expired. The collection of the payment takes place as soon as the period for the SEPA direct debit pre-notification has expired.
6. Delivery
6.1. We deliver the ordered goods to the delivery address specified by you in the order process.
6.2. Collection of the ordered goods is not possible.
7. Retention of Title
If we perform in advance (for example in the case of purchase on account), the goods remain our property until the purchase price has been paid in full.
8. Warranty
The statutory rights regarding liability for defects apply.
9. Transport Damage
If goods are delivered with obvious transport damage, please report such defects to the shipping or transport service provider as soon as possible and contact us immediately. Failure to make a complaint or to contact us has no consequences for your statutory or contractual warranty claims and their enforcement. However, you help us to assert our own claims against the shipping or transport service provider or the transport insurance.
10. Dispute Resolution
We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
11. Choice of Law
The law of the Federal Republic of Germany applies, without the conflict of law rules of private international law and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, the mandatory provisions of the law of the state in which you have your habitual residence remain unaffected.
12. Place of Jurisdiction
The place of jurisdiction for disputes arising from or in connection with the contract between you and us is our registered office, provided that you are a merchant, a legal entity under public law or a special fund under public law.

1. Geltungsbereich

1.2. Als Verbraucher gilt jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können. Abweichende, entgegenstehende oder ergänzende Bedingungen werden nur dann und insoweit Vertragsbestandteil, als wir ihrer Geltung ausdrücklich zugestimmt haben. 2. Vertragsschluss
2.1. Die Darstellung der Waren in unserem Online-Shop stellt ein rechtlich bindendes Angebot unsererseits zum Abschluss eines Vertrages dar. Sie können dieses Angebot annehmen, indem Sie die gewünschten Waren auswählen, in den Warenkorb legen, den Bestellprozess durchlaufen und den Button, der den Bestellprozess abschließt, anklicken. Alternativ können Sie dieses Angebot auch per E-Mail annehmen.
2.2. Der Vertragstext wird von uns nach dem Vertragsschluss gespeichert. Wir senden Ihnen die Daten Ihrer Bestellung und unsere allgemeinen Geschäftsbedingungen per E-Mail zu. 2.3. Die für den Vertragsschluss zur Verfügung stehenden Sprachen sind Deutsch und Englisch.

6. Lieferung
6.1. Wir liefern die bestellten Waren an die von Ihnen im Bestellprozess angegebene Lieferanschrift. Wenn es sich um digitale Güter handelt, werden diese an die angegebene E-Mail Adresse geliefert.
6.2. Eine Abholung der bestellten Waren ist nicht möglich.
7. Eigentumsvorbehalt
Falls wir in Vorleistung treten (beispielsweise beim Kauf auf Rechnung), bleiben die Waren bis zur vollständigen Zahlung des Kaufpreises unser Eigentum.
8. Gewährleistung
Es bestehen die gesetzlichen Mängelhaftungsrechte.
9. Transportschäden
Werden Waren mit offensichtlichen Transportschäden angeliefert, so reklamieren Sie solche Fehler bitte möglichst sofort beim Versand- bzw. Transportdienstleister und kontaktieren Sie uns bitte unverzüglich. Die Säumnis einer Reklamation oder Kontaktaufnahme hat für Ihre gesetzlichen oder vertraglichen Gewährleistungsansprüche und deren Durchsetzung keine Folgen. Sie helfen uns damit aber, unsere eigenen Ansprüche gegenüber dem Versand- bzw. Transportdienstleister bzw. der Transportversicherung geltend machen zu können.
10. Streitbeilegung
Zur Teilnahme an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle sind wir nicht bereit und nicht verpflichtet.
11. Rechtswahl
Es gilt das Recht der Bundesrepublik Deutschland ohne die Verweisungsnormen des Internationalen Privatrechts und unter Ausschluss des UN-Kaufrechts. Falls Sie Verbraucher sind, bleiben die zwingenden Vorschriften des Rechts im Staat Ihres gewöhnlichen Aufenthalts unberührt.
12. Gerichtsstand
Gerichtsstand für Streitigkeiten aus oder im Zusammenhang mit dem Vertrag zwischen Ihnen und uns ist unser Sitz, sofern Sie Kaufmann, juristische Person des öffentlichen Rechts oder öffentlich-rechtliches Sondervermögen sind.
